Labour law links the two parties in an employment relationship, irrespective of the form the contract takes. The existence of an employment relationship is the starting point for the application of all labour law rules. Without an employment relationship between the parties, the rules of labour law do not apply.

Labour Court
The Labour Court carries the full status of a High Court and is the highest authority (apart from the appeal courts) when it comes to labour disputes. The Labour Court may be approached directly in some cases, but also serves as a review court for parties who are unsatisfied with a decision by the CCMA or a bargaining council.
Our labour law attorneys specialize in matters involving the Labour Court, and appear in this Court personally and on a frequent basis.
Mutual Separation Agreements
- A Mutual Separation Agreement is the contract which sets out the terms upon which the working relationship has come to an end. In some instances the employer and employee agree that the working relationship should come to an end.
- In a Mutual Separation Agreement, the rights and obligations of the employer and employee are set out by means of a binding contract.
- By entering into an MSA, the parties avoid the unnecessary stress, costs, and time associated with a CCMA dispute.
- Our specialist labour lawyers assist employers with the preparation of mutual separation agreements which are fair, binding, and legally sound. We also assist employees who have been furnished with an MSA in an advisory capacity to ensure that their interests are looked after in the final signed MSA.
